These Aion Terms and Conditions when Adding Your Aion Card to a Third Party Digital Wallet (the "Terms") apply when you add an Aion Business Debit Visa® ("Aion Card" or “Card”) to a third party digital wallet or other payment service managed or owned by a third party ("Wallet"). In these Terms, "you" and "your" refer to the cardholder of the Aion Debit Card, and "we," "us," "our," and "Aion" refer to Aion and the issuer of your Aion Business Debit Visa®, Cross River Bank.
When you add an Aion Card to a Wallet, you agree to these Terms and Conditions:
You can add an eligible Aion Card to a Wallet by following the instructions of the Wallet provider. Only Aion Cards that we determine are eligible can be added to a Wallet. If your Aion Card or underlying account is not in good standing, that Aion Card may not be eligible to be added to or enrolled in the Wallet. We may determine other eligibility criteria at our sole discretion. When you add an Aion Card to a Wallet, the Wallet may allow you to (a) use the Aion Card to (i) enable transfers of money between you and others who are enrolled with the Wallet provider or a partner of such Wallet provider, and/or (ii) enter into transactions where the Wallet is accepted, including the ability to use the Aion Card to complete transactions at participating merchants' physical locations, e-commerce locations, and at ATMs; and (b) use other services that are described in the Wallet provider's agreement or that they may offer from time to time. The Wallet may not be accepted at all places where your Aion Card is accepted. We reserve the right to terminate our participation in any Wallet or with any Wallet provider at any time and the right to designate a maximum number of Aion Cards that may be added to a Wallet.
You should contact the Wallet provider on how to remove an Aion Card from the Wallet. You are solely responsible for removing an Aion Card from a Wallet.
Any applicable fees, charges and interest that apply to your Aion Card or underlying account will also apply when you use a Wallet to access your Aion Card. Aion does not charge you any additional fees for adding your Aion Card to a Wallet or using your Aion Card in a Wallet. The Wallet provider and other third parties such as wireless companies or data service providers may charge you additional fees. You are solely responsible for reporting and paying any applicable fees or taxes arising from transactions originated using your Aion Card information transmitted by a Wallet and you shall comply with any and all applicable tax laws in connection therewith.
Aion is not the provider of the Wallet, and Aion is not responsible for providing the Wallet service to you. Aion is only responsible for supplying information securely to the Wallet provider to allow usage of the Aion Card in the Wallet. Aion is not responsible for any failure of the Wallet, for any errors, delays caused by or the inability to use the Wallet for any transaction. We are not responsible for the performance or non-performance of the Wallet provider or any other third parties regarding any agreement you enter into with the Wallet provider or associated third-party relationships that may impact your use of the Wallet.
You agree and acknowledge that the transaction history displayed in the Wallet solely represents our authorization of your Wallet transaction and may not reflect complete information about the transaction, nor any post-authorization activity, including but not limited to clearing, settlement, foreign currency exchange, reversals, returns or chargebacks. Accordingly, the purchase amount, currency, and other details for the Wallet provider's transaction history in connection with use of your Card in the Wallet may be preliminary and/or incomplete, and may not match the transaction amount that ultimately clears, settles, and posts to your Aion monthly statement, which shall be deemed the prevailing document.
The terms and agreement that govern your Aion Card do not change when you add your Aion Card to the Wallet. The applicable Aion Agreement or account agreement that governs the Aion Card, as amended from time to time, are incorporated by reference as part of these Terms. Please review those agreements, as applicable, for important information on your rights and responsibilities when making transactions through a Wallet. The Wallet simply provides another way for you to make purchases or other transactions with the Aion Card.
Your privacy and the security of your information are important to Aion. Our Aion Privacy Policy (available online at: https://www.aionfi.com/ ) applies to your use of your Aion Card in the Wallet. You may be provided with the ability to share your Aion Card number with Wallet providers or a payment network, and you agree that we may share your other information with the Wallet providers, merchants, a payment network, and others in order to provide the services you have requested, to make information available to you about your Aion Card transactions, and to improve our ability to offer these services. This information helps us to add your Aion Card to the Wallet and to maintain the Wallet. We do not control the privacy and security of your information that may be held by the Wallet provider and that is governed by the privacy policy given to you by the Wallet provider.
We can terminate these Terms at any time. We can also change these Terms, or add or delete any items in these Terms, at any time. Your use of an Aion Card in a Wallet after we have made such changes available will be considered your agreement to the changes. We will provide notice if required by law. We can also assign these Terms. Furthermore, subject to applicable law, at any time we may (i) terminate your use of any Aion Card in connection with a Wallet, (ii) modify or suspend the type or dollar amounts of transactions allowed using Aion Cards in connection with a Wallet, (iii) change an Aion Card's eligibility for use with a Wallet and/or (iv) change the Aion Card authentication process. You cannot change these terms, but you can terminate these Terms at any time by removing all Aion Cards from the Wallet. You may not assign these Terms.
We can provide notices to you concerning these Terms and your use of an Aion Card in the Wallet by posting the material on our website, through electronic notice given to any electronic mailbox we maintain for you or to any other email address or telephone number you provide to us, or by contacting you at the current address we have on file for you.
You consent to receive electronic communications and disclosures from us in connection with your Aion Card and the Wallet. You agree that we can contact you by email at any email address you provide to us in connection with any Aion product, service or account, or through the mobile device on which you have downloaded the Aion Mobile app. It may include contact from companies working on our behalf to service your accounts. You agree to update your contact information with us when it changes.
These Terms are governed by federal law and Wallet services shall be deemed a passive one that do not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than New Jersey, where your Aion Card is covered. Disputes arising out of or relating to these Terms will be subject to any dispute resolution procedures in your Aion Terms and Conditions.
WE ARE NOT AND SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR INJURY OR FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATED TO YOUR ADDING AN AION CARD TO A WALLET, OR YOUR ACCESS OR USE OF A WALLET. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS) AS TO ANY AND ALL WALLETS AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT INCLUDED IN OR ACCESSIBLE FROM THE WALLETS.

The Aion Business Debit Visa® is issued by Cross River Bank, Member FDIC pursuant to a license from Visa, Inc., and may be used everywhere Visa is accepted.
