Aion Digital Wallet Terms & Conditions

These Aion Digital Wallet Terms and Conditions (the "Terms") apply when you add an Aion Business Debit Visa® ("Aion Card" or “Card”) to a third party digital wallet or other payment service managed or owned by a third party ("Wallet"). In these Terms, "you" and "your" refer to the cardholder of the Aion Debit Card, and "we," "us," "our," and "Aion" refer to Aion and the issuer of your Aion Business Debit Visa®, Cross River Bank.

Access and use of our website are governed by our Terms of Use and Banking Terms of Service. In addition to this Agreement, our Banking Terms ofService and Terms of Use contain additional terms and conditions that governaccess and use of our mobile device application. Aion reserves the right tomake unilateral modifications to these Agreements and Policies and willprovide notice of these changes by posting an updated version to our legalpage. If you do not accept all applicable agreements and policies, and theprocedures for modifying those agreements and policies, do not submit anapplication to Aion and do not use any services offered on aionfi.com. Use ofany such services will be deemed to be acceptance of all applicable agreements and policies at aionfi.com/terms-of-use.

When you add an Aion Card to a Wallet, you agree to these Terms and Conditions:

1. Adding Your Aion Card to a Third Party Wallet

You can add your eligible Aion Cards to supported digital wallets (e.g., ApplePay, Google Pay, Samsung Pay) on compatible devices and use the digital versions to make contactless, in-app, and online purchases at merchants that accept digital wallet payments. Only Aion Cards that we determine are eligible may be added. If your Aion Card or underlying account is not in good standing, that Card may not be eligible. We may determine additional eligibility criteria at our sole discretion. When added, your Aion Card may allow you to: (a) use the Aion Card to enable transfers of money between you and others who are enrolled with the wallet provider, and/or enter into transactions where the wallet is accepted, including in-store, online, or ATM transactions; (b) use other services described in the wallet provider's agreement or offered from time to time.

2. Fees

Any applicable fees, charges, and interest that apply to your Aion Card or underlying account will also apply when using a wallet to access your Aion Card. Aion does not charge additional fees for adding your Card to a wallet.Wallet providers or other third parties may charge additional fees. You are responsible for reporting and paying any applicable taxes arising from transactions. Please see the Aion fees schedule for all applicable fees.

3. Aion Is Not Responsible for the Wallet

Aion is not the provider of the wallet and is not responsible for wallet performance, errors, delays, or inability to use the wallet. Aion supplies information securely to allow usage of your Card in the wallet.

4. Your Transaction History

The transaction history displayed in the wallet represents authorization of your wallet transaction and may not reflect complete information including clearing, settlement, foreign currency exchange, reversals, returns, or chargebacks. The Aion monthly bank statement shall be the prevailing document.

5. Aion Terms Do Not Change

The terms governing your Aion Card do not change when added to a wallet. Applicable Aion Agreements are incorporated by reference. The wallet provides another way to make transactions with the Aion Card. All Aion agreements can be found at: aionfi.com/aion-terms-of-use

6. Aion Privacy

Our Privacy Policy applies to your use of your Aion Card in the wallet. We may share your information with wallet providers, merchants, payment networks, and others to provide services, facilitate transactions, and improve services. We do not control the privacy or security of information held by the wallet provider.

7. Suspension; Cancellation

Aion reserves the right to suspend, block, or terminate your use of a Card in any digital wallet at any time for any reason, including suspected fraud or account closure.

8. License

A digital version of your Card is licensed, not sold, to you. You are granted a non-transferable, limited license to use your Card through supported digital wallets in accordance with these Terms.

9. Security and Push Notifications

You are responsible for maintaining the confidentiality of device credentials and any means used to access your wallet. Anyone with device access may authorize transactions using your Card. You may receive push notifications from wallet providers; you may disable them if desired.

10. Disputes & Governing Law

These Terms are governed by federal law and Wallet services shall be deemed a passive one that do not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than New Jersey, where your Aion Card is covered. Disputes arising out of or relating to these Terms will be subject to any dispute resolution procedures in your Aion Terms and Conditions.

11. Notices and Communications

We may provide notices via our website, electronic mail, or mobile device. By adding your Card, you consent to receive electronic communications from Aion and wallet providers.

12. Disputes & Governing Law

These Terms are governed by federal law and any dispute resolution provisions in your Aion Card agreements. Wallet services are passive and do not create personal jurisdiction outside New Jersey.

13. Limitation of Liability; No Warranties

Aion shall not be liable for any loss, damage, or injury arising from adding a Card to a wallet or using the wallet. We disclaim all warranties to the fullest extent permitted by law.

WE ARE NOT AND SHALL NOT BELIABLE FOR ANY LOSS, DAMAGE OR INJURY OR FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATED TO YOUR ADDING AN AION CARD TO A WALLET, OR YOUR ACCESSOR USE OF A WALLET. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS) AS TO ANY AND ALL WALLETS AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT INCLUDED IN OR ACCESSIBLE FROM THE WALLETS.

14. Governing Law and Disputes

These Terms are governed by the laws applicable to your Aion account, subject to any dispute resolution provisions contained in your Aion account agreement.
